§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses via our online shop good-smokes.de.
A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
The version of these GTC valid at the time of the order applies.
§ 2 Conclusion of Contract
The presentation of our products in the online shop does not constitute a legally binding offer, but an non-binding invitation to place an order (invitatio ad offerendum).
By submitting an order, you make a binding offer to purchase the products contained in the shopping cart. Confirmation of receipt of the order will be sent immediately after submission via an automated email. This confirmation of receipt does not yet constitute acceptance of your offer.
The contract is concluded when we accept your order by means of a shipping confirmation or by delivery of the goods.
§ 3 Prices and Payment
All stated prices are final prices in Euros and include the statutory value added tax. Shipping costs are shown separately and are to be borne by the customer, unless otherwise stated.
Available payment methods are displayed during the ordering process. Payment is due upon completion of the order.
§ 4 Delivery and Shipping
Delivery will be made to the delivery address specified by the customer. Delivery times and shipping costs are indicated on the respective product page and in the order process.
Unless otherwise agreed, delivery will be made within Germany. Shipping costs for international deliveries are shown separately in the ordering process.
Should a product be temporarily unavailable, we will inform you immediately and refund any payments already made without delay.
§ 5 Retention of Title
The delivered goods remain our property until full payment has been received.
§ 6 Right of Withdrawal
Instructions on Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You bear the direct cost of returning the goods.
§ 7 Warranty
Statutory warranty rights apply. In the event of defects in the delivered goods, you are entitled to the statutory warranty claims against the seller.
§ 8 Liability
We are liable without limitation for intent and gross negligence. For slight negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations) and only for the foreseeable, typical damage.
The above limitations of liability do not apply to damages resulting from injury to life, body, or health, as well as for claims under the Product Liability Act.
§ 9 Youth Protection
Our product range is exclusively aimed at adults (18 years and older). By placing your order, you confirm that you have reached the age of 18.
§ 10 Data Protection
Information on the processing of your personal data can be found in our privacy policy.
§ 11 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
